Terms & Conditions – Healthy Ageing Platform

These Terms & Conditions, as amended from time to time, apply to all agreements and services of Healthy Ageing Platform Ltd, registered under number HE 475859, operating under the name Healthy Ageing Platform (hereinafter “Healthy Ageing Platform”), and form an integral part of all legal relationships between the Customer and Healthy Ageing Platform.

1. DEFINITIONS

For the purposes of these Terms & Conditions, the following capitalized terms are used. These terms mean:

a) Terms & Conditions: these Terms & Conditions.
b) Reflection Period: the period during which the Customer can exercise the Right of Withdrawal.
c) Services: a collective term for all services that Healthy Ageing Platform provides via the Platform, including integrated training programs in fitness, health, conditioning, recipes, and wellness.
d) Right of Withdrawal: the right of the Customer to cancel the membership within the Reflection Period.
e) Customer: a natural person who subscribes to one or more Services from Healthy Ageing Platform.
f) Membership: the agreement between the Customer and Healthy Ageing Platform regarding access to and use of the Platform.
g) Platform: the interactive video platform of Healthy Ageing Platform, accessible via www.healthyageingplatform.com and/or the Healthy Ageing Platform app, through which Healthy Ageing Platform offers its Services.

2. OFFERS

If an offer has a limited validity period or specific conditions, this will be explicitly stated. All offers and other expressions by Healthy Ageing Platform are non-binding and constitute an invitation to purchase Services. Healthy Ageing Platform reserves the right to modify its offers. This means the Customer cannot claim offers or prices other than the one the Customer has accepted. Obvious mistakes or errors in the offer do not bind Healthy Ageing Platform, and no rights can be derived from them. Healthy Ageing Platform reserves the right to refuse registration of a Customer without giving reasons.

3. AGREEMENT AND SERVICES

Membership is established when the Customer registers via the Platform by creating an account, and Healthy Ageing Platform confirms the registration. The Customer must be at least eighteen (18) years old. When purchasing multiple Services, each purchase constitutes a separate Membership agreement between the Customer and Healthy Ageing Platform. Healthy Ageing Platform may engage third parties for the execution and delivery of Services.

3a. MEMBERSHIP CONTENT

Membership provides the Customer access to the interactive Platform, including all regular training programs, instructional videos, recipes, and additional content made available via the Platform.

Regular membership includes:
a) A 6-week preparatory training program, designed to introduce the Customer to the exercises and ensure correct execution;
b) Training programs renewed every 4 weeks, throughout the membership, up to a maximum of 36 different programs.

If a Customer remains a member beyond the period during which the 36 programs have been offered (36 x 4 weeks), no new programs will be added. The Customer retains access to all 36 previously offered programs as long as the membership remains active.

Access to short-term modules with a one-time payment (e.g., the 6-week balance series) is dependent on an active membership, as described in Article 5a.

Healthy Ageing Platform reserves the right to update, adapt, or temporarily make content unavailable, taking reasonable account of the Customer’s interests.

4. RIGHT OF WITHDRAWAL

For every agreement, the Customer has a 14-day Reflection Period, during which the membership can be cancelled without giving reasons. Healthy Ageing Platform may ask for the reason, but the Customer is not obliged to provide it. The Reflection Period expires 14 days after the day the membership is concluded.

If the Right of Withdrawal is exercised within the Reflection Period, the Customer owes Healthy Ageing Platform a proportional amount for the part of the membership already fulfilled at the time of exercising the Right of Withdrawal. The proportional amount is calculated based on the total price set in the Agreement. The Customer is also obliged to return the welcome gift. Only after receipt will the corresponding payment be refunded. Withdrawal may be communicated via the model form or in another clear and unambiguous manner.

5. MEMBERSHIP AND PAYMENT

Membership is taken for a period of 1 year and is automatically renewed. Payment is via direct debit, with a choice of monthly, quarterly, or yearly collection. By using the payment link sent by Healthy Ageing Platform for direct debit, the Customer authorizes Healthy Ageing Platform to collect future payments from the relevant account.

Direct debit occurs no later than 14 days after the agreement is concluded. Periodic collection is made in advance of each service period. In case of late payment, for example due to returned debits or insufficient funds, a fee of EUR 2.50 will be charged. If payment is not made after the first reminder, Healthy Ageing Platform is entitled to suspend access to the Services immediately or terminate membership, without prejudice to its right to compensation and to recover outstanding payments and associated collection costs under applicable law. Invoices and payment reminders are provided electronically. The periodic membership fee remains the same throughout the membership period, unless Healthy Ageing Platform decides to index prices for new or renewed memberships.

5a. SHORT-TERM MODULES / ONE-TIME PAYMENT

In addition to regular membership, Healthy Ageing Platform offers short-term modules for a one-time payment (e.g., the 6-week balance series).

The Customer receives access to the module for the duration of their active membership. If the Customer cancels or terminates the membership, access to all previously purchased one-time modules will automatically expire, regardless of completion. Payment for a short-term module is non-refundable, unless legally required otherwise. Healthy Ageing Platform reserves the right to temporarily block access to modules in case of non-compliance with the Terms or non-payment of the regular membership.

6. ACCOUNT AND SECURITY

The Customer must provide accurate and complete information when creating an account. Incorrect information must be corrected immediately, and incomplete information must be completed. The Customer is responsible for maintaining the confidentiality of their account, including login credentials. Unauthorized use must be reported immediately.

7. PLATFORM USE

The Customer may not use the Platform in a way that endangers its functioning or compromises the content or underlying software. Use is limited to personal and non-commercial purposes.

8. PLATFORM AVAILABILITY

Healthy Ageing Platform strives to provide uninterrupted access but cannot exclude disruptions due to internet connections, technical infrastructure, or other circumstances. If the Customer experiences an unexpected disruption, they should contact customer support. Healthy Ageing Platform will make reasonable efforts to resolve it promptly. Maintenance may require temporary unavailability, with prior notice where possible.

The training program consists of 13 modules, renewed every 4 weeks during the first year of membership, while previous programs remain accessible.

9. THIRD PARTIES / WEB SHOP

The Platform may offer third-party products. If the Customer accesses a third-party website, their terms, privacy, and cookie policies apply. Healthy Ageing Platform is not liable for these. Some Services may require third-party software, subject to separate terms.

10. CHANGES TO AGREEMENT / SERVICES

Healthy Ageing Platform may amend the Terms at any time. Customers will be informed and may terminate the Agreement free of charge, unless the changes are minor and termination is unreasonable.

11. SUSPENSION AND TERMINATION BY HEALTHY AGEING PLATFORM

Healthy Ageing Platform may suspend access or terminate the Agreement if the Customer:
a) Violates these Terms
b) Is legally incapacitated or placed under guardianship
c) Applies for debt restructuring under applicable law
d) Declares bankruptcy

Temporary suspension may be granted for illness, injury, or pregnancy up to 6 months, upon submission of a medical certificate or other satisfactory proof. Suspension cannot be retroactive.

12. TERMINATION BY CUSTOMER

After one year, the Customer may terminate membership with one month notice. If not terminated, membership is automatically renewed indefinitely. Termination may be done via email: info@healthyageingplatform.com

13. CUSTOMER RESPONSIBILITY / LIABILITY

The Customer uses Services and the Platform at their own risk. They must consult their doctor before participating. The Customer is responsible for taking precautions to prevent injury and ensuring a safe environment. The Customer is liable for damages to Healthy Ageing Platform caused by violating these Terms or by intent or reckless behavior.

13a. RISKS OF TRAINING MATERIALS

Customers acknowledge that using training materials (bands, weights, etc.) carries a risk of injury. Materials must be used according to instructions (written or video).

Warnings:

Bands may snap or break.

Improper use may cause bodily injury, including eye injuries.

Children, vulnerable persons, or those with medical limitations may participate only under supervision.

Use of protective equipment (e.g., eye protection) is recommended. Customers must ensure a safe exercise environment with adequate space, a solid floor, and no obstacles.

14. LIABILITY OF HEALTHY AGEING PLATFORM

Healthy Ageing Platform is not liable for injuries, trauma, or death occurring before, during, or after training. Information and advice are provided to the best of our knowledge, but no guarantees are given. Liability is limited to direct damages and excluded in cases of indirect, immaterial, or consequential losses.

14a. LIMITATION OF LIABILITY FOR MATERIAL USE

Healthy Ageing Platform is not liable for injury or damage arising from:
a) Materials snapping or malfunctioning
b) Improper use of materials
c) Ignoring instructions or safety warnings
d) Use by third parties or children without supervision

Liability remains in cases of intent, gross negligence, or as legally required. The Customer indemnifies Healthy Ageing Platform against third-party claims arising from misuse.

15. FORCE MAJEURE

Healthy Ageing Platform is not liable for delays or non-performance caused by force majeure, including internet outages, technical failures, or third-party interference.

16. INTELLECTUAL PROPERTY

All intellectual property rights on Services and Platform content belong to Healthy Ageing Platform unless stated otherwise. No reproduction, storage, public display, framing, editing, or derivative works are allowed without written consent. Sharing news intended for social media is allowed.

17. TRANSFER OF RIGHTS

The Customer may not transfer rights or obligations without consent. Healthy Ageing Platform may transfer rights or obligations without Customer consent.

18. INVALID PROVISIONS

Invalid or unenforceable provisions do not affect the remaining Terms. They will be replaced by provisions closest to the original intent.

19. PRIVACY

Personal data and cookies are processed in accordance with the Healthy Ageing Platform Privacy Policy: www.healthyageingplatform.com

20. GOVERNING LAW AND JURISDICTION

Dutch law applies. Disputes will be resolved by the court in Amsterdam, unless otherwise required by consumer protection laws.

EFFECTIVE DATE

These Terms & Conditions are effective 1 January 2026.
